Norcross, GA – In a 6–3 ruling, the United States Supreme Court allowed parts of Trump’s Executive Order (aimed at denying citizenship to children born to immigrant parents on U.S. soil) to move forward. While the Court did not rule on whether the Executive Order was constitutional, its decision opens the door to a future where U.S. citizenship rights vary, depending on where one lives and their ability to fight back in court.

“This ruling sends a chilling message,” said Jerry Gonzalez, CEO of GALEO Impact Fund. “The Supreme Court just opened the door to a fractured, unequal system where a child’s U.S. citizenship — and future — may depend on where they’re born or whether their family can afford legal help. Birthright citizenship isn’t up for negotiation. Citizenship is not a partisan issue. It is not a bargaining chip. This is a fundamental constitutional right, and no executive order or court shortcut can erase that.”

While the Court did not decide on the constitutionality of the Executive Order itself, the ruling permits its enforcement in some regions, laying the groundwork for confusion, discrimination, and legal chaos across the country.

This decision threatens to leave some U.S.-born children functionally stateless, denying them access to healthcare, education, and the right to participate in civic life fully. Families could be denied birth certificates or U.S. citizenship documentation based on arbitrary geography and political will.

As legal challenges continue, GALEO Impact Fund urges the Court to ultimately reject this Executive Order and reaffirm the 14th Amendment’s clear promise: anyone born in the United States is a citizen of the United States.
