In the Spring of 2020, former President Donald Trump brought back the law known as Title 42, a plan that was a part of the Public Health Service Act in 1944 that put restrictions on who can enter the United States in the midst of a pandemic. President Joe Biden had kept this mandate in place until now, planning to end it on May 23. Since this announcement, reactions from both parties have been mixed as to whether or not it is too soon to lift these restrictions.
From the beginning, many citizens believed that Trump’s decision to bring back Title 42 in the first place was one of his many acts of hostility towards immigrants coming into the country. Even more backlash towards the policy appeared after images of US border agents on horseback attacking Haitian immigrants, seeking asylum after the assasination of Haitian President Jovenel Moise, began showing up online. In addition to this, when the policy was first implemented, CDC director Robert Redfield stated that there were only 53 confirmed cases of COVID-19 in Mexico while the US had already had over 2,000. A few days after the new restrictions were implemented, the US had close to 20,000 cases within its borders. The virus was already inside, and Title 42 was seen as “just another xenophobic tool used by an America that has a tradition of blaming diseases on foreigners” (Varela 2022). The advocacy group Physicians for Human Rights have been fighting to put an end to this policy, stating that Title 42 is “a grave misuse of public health as a pretext to end asylum.” (Muller, Biekert 2022).
Although President Biden recently declared an end to this policy, it lasted over 2 years into his presidency and denied over 1.6 million immigrants entry into the country. Biden has been receiving criticism over this since one of his main goals since his election had been to right the wrongs that Trump had done in regards to his treatments of immigrants. Some states are criticizing Biden for lifting the policy, even going as far as attempting to sue the Biden administration. Senate Minority Leader Mitch McConnell states that the Democrats’ move to end Title 42 is ironic, since they are always talking about how the pandemic is not over and they are willing to lift a mandate that’s whole purpose is to stop the spread from continuing.
From the beginning, the application of the policy was only used as one of many attacks that the Trump administration had directed towards immigrants. The US had already had the virus within its borders, and immigrants were being blamed irrationally. The removal of Title 42, although coming much later than promised, is a step in the right direction.

En la primavera de 2020, el ex presidente Donald Trump trajo de vuelta la ley conocida como Título 42, un plan que fue parte de la Ley de Servicio de Salud Pública en 1944 que puso restricciones a quienes pueden entrar a los Estados Unidos en medio de una pandemia. El presidente Joe Biden había mantenido este mandato hasta ahora, declarando los planes para terminarlo el 23 de mayo. Desde este anuncio, la reacción de ambas partes ha sido mixta en cuanto a si es demasiado pronto o no para levantar estas restricciones.
Muchos ciudadanos desde el principio creyeron que la decisión de Trump de recuperar el título 42 en primer lugar fue uno de sus muchos actos de hostilidad hacia los inmigrantes que entran en el país. Aún más reacciones negativas hacia la política aparecieron después de que las imágenes de agentes fronterizos estadounidenses a caballo atacando a inmigrantes haitianos que buscan asilo después de que el asesinato del presidente haitiano Jovenel Moise comenzara a aparecer en línea. Creo que la eliminación del título 42, aunque llega mucho más tarde de lo prometido, es un paso en la dirección correcta.
